DUI Penalty Enhancement: Causing Bodily Harm to Another While Impaired

Section 23153 of the California Vehicle Code imposes an additional penalty enhancement to any offender who causes bodily injury or harm to another while driving under the influence of alcohol and/or drugs and is proven to be operating a motor vehicle or vessel while impaired.

In California, the law states that any injury caused to another person, other than the defendant, while driving a vehicle or vessel with an blood alcohol of .08% or above is a more serious offense than non-aggravated DUI, and will be punished more severely.

The blood alcohol limit for a driver in a commercial vehicle is .04%, and any driver operating a commercial vehicle while driving under the influence with a bac of .04% or above who causes bodily injury or harm to another will be subject to increased punishment.
