California DUI Penalty Enhancement: BAC .15% or Above

California Law imposes additional punishment, termed a DUI Penalty Enhancement, for any DUI offense where it can be proven that the driver had a blood alcohol content of .15% or above while operating a motor vehicle or vessel.

Excessive BAC Punishment

Driving with a bac of .15% or above is considered an excessive blood alcohol content and subject to a specific DUI Penalty Enhancement, or added punishment, under California Vehicle Code §23578, shall be required to participate in and successfully complete a 9 month drinking & driving program.

Driving with an excessive BAC will also be a contributing factor as to whether or not a DUI defendant will be granted probation in lieu of more severe punishment & sentencing.
